These Terms of Use govern your use of the DietaBest website at dietabest.com and all its language versions (including en/), operated by DietaBest Digital Services, ul. Prosta 32, 00-838 Warsaw, Poland ("DietaBest", "we", "us").

By accessing or using the site, you agree to these Terms. If you do not agree, please stop using the site. These Terms apply alongside our Privacy Policy, Cookie Policy and, where applicable, our Terms of Purchase.

2. Eligibility

You must be at least 18 years old to use this website and to make purchases. By using the site, you confirm that you meet this age requirement. If you are under 18, please do not use this site or submit any personal data.

Calculator results are indicative estimates only and cannot replace professional medical assessment.

4. Use of calculators and tools

Our calculators (BMI, calorie, TDEE, BMR and others) are support tools based on publicly established formulas (e.g. Mifflin-St Jeor, WHO BMI classification). Results are approximate and depend on the accuracy of the data you enter. We make no warranties regarding the accuracy, completeness or suitability of calculator results for your personal circumstances.

5. Digital products and purchases

We offer digital educational products (PDF plans) for purchase on this site. All purchases are subject to our Terms of Purchase, which form a separate and binding agreement at the time of payment. Key points:

  • Purchases are one-time payments — no subscription or recurring charge.
  • Digital products are delivered immediately after payment confirmation.
  • Payment is processed by Stripe; we do not store your card data.

6. User conduct

8. Third-party services

DietaBest is not responsible for the content, availability or practices of any third-party services. Links to third-party sites do not imply endorsement.

9. No warranties

The site and all content are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • the site will be uninterrupted, error-free or free of viruses or other harmful components;
  • calculator results will be accurate for your individual circumstances;
  • following any content or plan will achieve specific health or body-composition outcomes.

10. Limitation of liability

To the fullest extent permitted by applicable law, DietaBest Digital Services shall not be liable for:

  • any indirect, incidental, special, consequential or punitive damages arising from your use of the site or our content;
  • health consequences from following diets, plans or advice presented on the site without professional consultation;
  • loss of data, revenue or business resulting from use of or reliance on site content;
  • temporary unavailability of the site or any technical errors.

Our total aggregate liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim (or €100 if no payment was made).

11. Indemnification

You agree to indemnify and hold harmless DietaBest Digital Services, its directors, employees and agents from any claims, liabilities, losses, damages and expenses (including reasonable legal fees) arising from: (a) your violation of these Terms; (b) your misuse of the site or any content; or (c) your violation of any third-party rights.

Some content on this site may be created or assisted by AI tools. Such content has been reviewed for quality and accuracy before publication, but may contain errors. It is not a substitute for professional advice. See our AI disclaimer for more details.

13. Governing law and disputes

These Terms are governed by the laws of Poland (as the jurisdiction of DietaBest Digital Services), without prejudice to any mandatory consumer protection rights you may have under the laws of your country of residence.

In the event of a dispute, we encourage you to contact us first at support@dietabest.com to seek an amicable resolution. If no resolution is reached, disputes shall be referred to the competent courts of Poland, or where applicable to ADR mechanisms in your jurisdiction.

EU consumers may use the European Commission's Online Dispute Resolution (ODR) platform.

14. Changes to these Terms

We reserve the right to update these Terms at any time. The updated version will be published on this page with a new "Last updated" date. Continued use of the site after changes constitutes acceptance of the updated Terms. For purchases already completed, the Terms in force at the time of purchase apply.

15. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect. Any unenforceable provision will be interpreted as closely as possible to its original intent.
